Linda represents financial institutions, oil and gas producers, and a variety of other publicly traded companies in complex commercial litigation matters at both the state and federal level. While she has handled a wide variety of commercial litigation disputes, Linda has developed particular expertise in the area of commercial mortgage-backed securities related litigation; intellectual property protection in a changing corporate environment; executive employment agreements; and commercial contract disputes, including disputes arising under oil and gas operating agreements. Linda also has extensive experience in the drafting and enforcement of covenants not-to-compete and in cases enforcing common-law duties of confidentiality and loyalty.

Representative Experience

  • Successfully tried first post-9/11 lawsuit confirming lenders’ rights to require borrowers to maintain insurance against acts of terrorism for properties securing loans included within a CMBS pool
  • Defended on appeal to the Fifth Circuit Court of Appeals summary judgment dismissing employment discrimination claims brought by a physician against a large Houston hospital
  • Obtained dismissal of multi-million dollar claim against former executive of sterilization test manufacturer on jurisdictional grounds, and successfully defended the dismissal on appeal to the Fifth Court of Appeals in Dallas
  • Regularly advises and negotiates on behalf of high-level executives through employment status changes caused by corporate merger, acquisition or asset sale
